Arkansas State Overview
Stormwater runoff (discharge) from Arkansas construction sites is regulated under section 402 of the Clean Water Act (CWA). Section 402 outlines the National Pollutant Discharge Elimination System (NPDES) permitting program. The Arkansas Department of Environmental Quality (ADEQ)’s stormwater management program is one whose regulations are comprised of three different General Permits: (1) The Construction General Permit; (2) The Industrial General Permit and (3) The Sewer System (MS4) Permit.
An operator of a construction site is required to apply for ADEQ Construction General Permit coverage if he/she will be discharging into waters of the state of Arkansas. More specifically, an operator or discharger is required to apply for an ADEQ General Permit if his/her project site will include (1) land disturbing activities equal to, or greater than one (1) acre; (2) construction activities involving less than one (1) acre but is part of a common plan of development or sale equal to or greater than one (1) acre; and (3) where discharges enter surface waters of the state.
The rules and regulations associated with the Arkansas Construction General Permit for discharges from large and small construction activities is intended to protect the natural water resources of the State of Arkansas. These regulations are vital to Arkansas’ effort to protect and improve water quality within the state. These important regulations were framed in accordance with the provisions of the Arkansas Water and Air Pollution Control Act and the Clean Water Act.

Arkansas Permit Application Process
Any person requiring coverage under the Arkansas Construction General Permit must first create a Storm Water Pollution Prevention Plan (SWPPP) for the site and submit a complete and accurate Notice of Intent (NOI) form to the Department at the following address:

Owner/operators who submit a NOI in accordance with the requirements of this permit are authorized to discharge stormwater from construction sites under the terms and conditions of the Arkansas Construction General Permit two weeks after the date the NOI is deemed complete by ADEQ. If the Notice of Coverage (NOC) has not been received by the permittee two weeks after the date the NOI is deemed complete by ADEQ, the NOI should be posted until the NOC is received.
If the NOI is deemed incomplete, the Department will notify the applicant with regard to the deficiencies by a letter, email, or phone within ten (10) business days of receipt of NOI. If the operator does not receive a notification of deficiencies from ADEQ’s receipt of the NOI, the NOI is deemed complete.
If the construction site is within the jurisdiction of a Qualified local Program (QLP), the operator of the construction site is authorized to discharge stormwater associated with construction activity under QLP permit requirements only. At the time this content was prepared the City of Hot Springs was the only city specific permit (QLP permit). This permit may be modified to add new QLPs or modify existing QLPs at the Department’s discretion.
Arkansas Storm Water Pollution Prevention Plan Requirements
A Storm Water Pollution Prevention Plan (SWPPP) must be prepared in accordance with good engineering practices by qualified person before submitting the Notice of Intent for permit coverage. At least one SWPPP must be developed for each construction project or site covered by this permit. The SWPPP must describe how the permittee will effectively design, install and maintain effective erosion controls, sediment controls and pollution prevention measures appropriate for the site conditions.

Arkansas Construction Storm Water Inspection Frequency
Stormwater compliance inspections must be conducted by a “qualified person”. A qualified person is a person knowledgeable in the principles and practice of erosion and sediment controls who possesses the skills to assess conditions at the construction site that could impact stormwater quality and to assess the effectiveness of any sediment and erosion control measures selected to control the quality of stormwater discharges from the construction activity.
A rain gauge must be maintained on-site and the inspection schedule must be specified in the Stormwater Pollution Prevention Plan (SWPPP). Inspections must be conduct at least once every 7 calendar days, or at least once every 14 calendar days and within 24 hours of the end of a storm event of 0.5 inches or greater

Arkansas Construction Stormwater - Credential Requirements
The Arkansas Department of Environmental Quality (ADEQ) mandates that inspections must be conducted by and SWPPPS be prepared by “Qualified Personnel” as provided by the operator of the construction site. A “Qualified Personnel” is defined as a person knowledgeable in the principles and practices of erosion and sediment control who possesses the skills to assess conditions at the construction site that could impact stormwater quality and to assess the effectiveness of any erosion and sediment control measures selected to control the quality of stormwater discharges from the construction activity.
The permittee is responsible for training personnel who are responsible for implementing activities identified in the SWPPP on the components and goals of the SWPPP and the requirements of the general permit. This includes contractors and subcontractors. Training should be given by a knowledgeable and qualified trainer. The SWPPP shall identify periodic dates for such training and records of training must be maintained with the SWPPP. Training records that are maintained electronically (i.e. database, etc) do not need to be maintained with the SWPPP, but must be accessible upon request.

Arkansas Final Stabilization for Construction Activities
Stabilization measures shall be initiated as soon as practicable in portions of the site where construction activities have temporarily ceased, but in no case more than fourteen (14) days after the construction activity in that portion of the site has temporarily or permanently ceased, except where construction activity is temporarily precluded by snow cover and shall be initiated as soon as practicable. In arid, semiarid, and drought-stricken areas where initiating vegetative stabilization measures immediately is infeasible, alternative stabilization measures must be employed as specified by the permitting authority.
The Arkansas Department of Environmental Quality considers a site to be 100% stabilized when all stormwater discharges from construction activities authorized by this permit are eliminated, all temporary sediment controls are removed and properly disposed and the site is covered by 80% vegetation density.

Arkansas Stormwater Permit Termination Process - Notice of Termination (NOT)
Once final stabilization has been achieved and all clearing, grading, excavating or other earth disturbing activities have permanently ceased on the site; all construction materials, waste, and temporary erosion and sediment control measures (including any sediment that was being retained by the temporary erosion and sediment control measures) have been removed and properly disposed; operator may submit a complete Notice of Termination (NOT) to the Director.
Along with the NOT, pictures that represent the entire site should be submitted for review. Final stabilization is not required if the land is returned to its pre-construction agriculture use. Operators of small construction sites are not required to submit NOTs for their construction sites. However, final stabilization is required on all sites. If a Notice of Termination is not submitted when the project is completed, the operator will be responsible for annual fees.
