Nebraska Stormwater Management
Nebraska State Overview
The state of Nebraska and the Nebraska Department of Environmental Quality (NDEQ) was granted delegated authority to institute their own stormwater management program to work in concert and comply with the mandates of the Clean Water Act (CWA). Nebraska’s National Pollutant Discharge Elimination System (NPDES) Permitting Program encompasses the following areas of wastewater and stormwater:

Construction stormwater.

Industrial wastewater.

Municipal Separate Storm Sewer System (MS4) stormwater.

Livestock waste control discharge management.
Nebraska’s Construction Stormwater (CSW) General Permit grants coverage to project site owners or operators who will be discharging stormwater associated with both “small” and “large” construction activities to waters of the State. "Small Construction Activity," is defined as a disturbance to the land that results in a change in the topography, existing soil cover (both vegetative and non-vegetative), or the existing soil topography that may result in accelerated stormwater runoff, leading to soil erosion and movement of sediment into waters of the State or urban drainage systems. "Large Construction Activity," is defined as land disturbances from construction activities that will affect five (5) acres or more. “Construction Activity” also includes the disturbance of less than one (1) acre of total land area that is a part of a larger common plan of development or sale if the larger common plan will ultimately disturb one (1) acre or more and includes all areas of support activity.
* The Nebraska CSW General Permit is also applicable to those releases from project sites that will be discharged in the Municipal Separate Storm Sewer System (MS4) as well as Combined Sewer Overflows (CSOs).
