Illinois Stormwater Management
Illinois State Overview
The state of Illinois recognizes the regulations of section 402 of the Clean Water Act (CWA); which outlines the National Pollutant Discharge Elimination System (NPDES) permitting program. The Illinois Environmental Protection Agency (IEPA) mandates permit authorization to any permittee engaging in discharges of stormwater associated with industrial activity from construction sites that result in the disturbance of one (1) or more acres of total land area, or less than one (1) acre of total land but part of a larger common plan of development or sale. In addition, this permit authorizes discharges from construction sites recognized as having the potential to violate water quality standards by contributing a significant amount of pollutants to water bodies of the state.
*Note: This permit may only authorize stormwater discharge associated with industrial activity from a construction site that is mixed with a stormwater discharge from an industrial source other than construction, where:
(a) The industrial source is located at the same site as the construction activity.
(b) Stormwater discharges associated with industrial activity from the areas of the site where constuction activity is occurring are in compliance with the standards of this permit.
(c) Stormwater discharges from industrial activity occurring in locations other than where the construction activity is occurring are covered by a separate NPDES or individual discharging permit.
The Illinois NPDES General Permit does not authorize coverage of discharges from construction sites where stormwater runoff related to industrial activity originate from the construction site post project completion and once final stabilization has been achieved. Additionally, stormwater discharges associated with industrial activity that are subject to an existing individual NPDES permit are not authorized to receive coverage under this general permit.

Illinois Permit Application Process
Any Owner or operator needing to seek coverage to discharge stormwater runoff from a construction site must seek coverage under this general permit. In order to do so, a permittee must submit a Notice of Intent (NOI) in accordance with the following requirements:
· The mailing address and location of the project site for which the Notice of Intent (NOI) is submitted. (If a mailing address is not available, the latitudinal and longitudinal coordinates of the site are required.)
· Owner or operator’s name, address, telephone number, and status as either a Federal, State, private, or public entity.
· A list of the receiving waters for which permitted stormwater runoff will be discharged into.
· The number of the NPDES permit(s) that authorize coverage to discharge any non-stormwater related runoff.
· A description of the project including detailed site plans, an estimated timetable for major construction, and the estimated acreage that will be disturbed throughout the project duration.
· A complete and compliant Storm Water Pollution Prevention Plan (SWPPP).
· Proper signatory requirements are met:
(1) For a corporation, a responsible corporate officer or any person authorized or delegated to have signatory rights.
(2) For a partnership or sole proprietorship, the general partner or sole proprietor.
(3) For a municipality, State, Federal, or other public agency, a principal executive or ranking elected official.
Completed Notice of Intents (NOIs) and Storm Water Pollution Prevention Plans (SWPPPs) should be submitted to the Illinois Environmental Protection Agency at least thirty (30) days prior to the planned commencement of construction activity.

Facilities operating under approved local sediment and erosion plans should submit their Notice of Intent (NOI) and Storm Water Pollution Prevention Plan (SWPPP) to the governing local agency as well. Any owner or operator discharging unauthorized stormwater runoff and/or any pollutants not receiving permit coverage is in direct violation of Federal and State regulations for water quality standards.
Once approved, a copy of the letter of notification of coverage along with the General NPDES Permit for stormwater discharges from construction activity should be posted on the site for accessible public viewing.
Illinois Storm Water Pollution Prevention Plan Requirements
A Storm Water Pollution Prevention Plan (SWPPP) must be developed for any construction project covered under the Illinois General NPDES permit. The SWPPP should be designed with good engineering practices in mind. It is mandatory that the SWPPP identifies any potential sources of pollution which may impact the quality of stormwater discharges leaving the construction site. In response to identifying potential site pollutants, effective Best Management Practices (BMPs) should be implemented to ensure compliance with the terms and conditions of this permit. All Storm Water Pollution Prevention Plans (SWPPPs) are to be completed prior to start of any ground breaking construction activity and are required to include the following criteria:
(1) The name(s) of all contractors or subcontractors working within the construction site.
(2) Site description detailing the nature of the construction work, the sequence of activity to occur, and estimate of the total land area to be disturbed throughout construction activity.
(3) An estimate of the runoff coefficient of the site after the construction activity is completed.
(4) Site map that locates all drainage patterns, slopes, surface waters, site entrance and exit points, controls to prevent offsite sediment tracking from vehicles, areas of soil disturbance, locations of stormwater discharging, locations of all structural and non-structural control methods, and areas where stabilization practices are expected to occur.
(5) The name of receiving waters for which stormwater runoff will be discharged into.
(6) All Best Management Pratices (BMPs)/ additional control methods:
a. A description of structural practices used to provide erosion prevention and limit runoff from exposed soils within the site.
b. A description of the measures that will be utilized to control pollutants in stormwater discharges that will occur during both construction activity and post construction activity.
c. For any site discharging into “Impaired waters” identified by the Illinois Environmental Protection Agency, measures capable of withstanding a 25-year, 24-hour rain event must be included.
d. Recognition of all site waste disposal controls that demonstrate compliance with all Federal or State waste disposal regulations.
(7) List of all interim and permanent stabilization practices, including site-specific scheduling for the implementation of stabilization.
(8) A schedule for regular maintenance and inspections of site equipment, BMPs, etc…
(9) Proper signatory requirements from the person submitting the Storm Water Pollution Prevention Plan (SWPPP) or other authorized personnel. All contractors and subcontractors identified in the SWPPP must also sign using the following statement:
"I certify under penalty of law that Iunderstand the terms and conditions of the general National Pollutant Discharge Elimination System (NPDES) permit (ILR10) that authorizes the storm water discharges associated with industrial activity from the construction site identified as part of this certification."
All Storm Water Pollution Prevention Plans (SWPPPs) are required under this permit to be available for public viewing at any reasonable time upon request. It is the responsibility of the permittee to adhere to control methods that are at least as protective as the standards set by the Illinois Environmental Protection Agency’s Urban Manual. It is also encouraged that all control measures and Best Management Practices (BMPs) plan for environmental protection even after all land disturbing activity has ceased and final stabilization has been achieved.
*Note: All copies of the Storm Water Pollution Prevention Plan (SWPPP) and all other reports or notices acquired throughout the construction project duration are required to be kept for a period of at least three (3) years from the date that permit coverage expires.

Illinois Construction Storm Water Inspection Frequency
As part of the requirements of the SWPPP, the owner or operator of a construction site shall allow the Illinois Environmental Protection Agency (IEPA) or authorized representative to request permit documentation or inspect the construction site for overall compliance.
Qualified personnel are required to inspect areas of the construction site that have not been finally stabilized, structural control measures, and areas where vehicles enter and exit at least once every seven (7) days and within twenty-four (24) hours of the end of a rain event equaling 0.5 inches or greater.
*Note: “Qualified personnel” refers to someone knowledgeable in the practices of erosion and sediment control measures, such as a licensed professional engineer (P.E), a certified professional in erosion and sediment control (cpesc), a certified erosion and sediment and storm water inspector (cesswi), or any knowledgeable person capable of assessing conditions on the construction site that impact stormwater quality and the effectiveness of erosion and sediment control measures.
Based on the results of the inspection, a description of potential pollutants identified on the site must be revised within the Storm Water Pollution Prevention Plan (SWPPP) as soon as possible after the date of inspection. If Best Management Practices (BMPs) or other control measures need to be modified, the owner or operator has seven (7) days following the inspection for implementation.
A report detailing the name(s) and qualifications of personnel leading the inspection, inspection date, major observations relating to site pollution prevention methods and other Best Management Practices (BMPs), and any incidents of non-compliance should be documented within twenty-four (24) hours of the inspection or recognition of any non-compliant practices occurring on a construction site.
Note: If a situation of non-compliance occurs, the owner or operator must notify the appropriate local agencies within twenty-four (24) hours of the inspection date; and submit an Incidence of Noncompliance (ION) report for any violation of the Storm Water Pollution Prevention Plan (SWPPP) or Federal/State regulatory requirements for storm water discharge associated with construction activity within five (5) days of the inspection date. All Incidence of Noncompliance (NOI) reports are to be signed by a responsible or authorized personnel
Illinois Construction Stormwater - Credential Requirements
The state of Illinois recognizes a “qualified” or “responsible” personnel as someone that is knowledgeable in the principles and practices of erosion prevention methods, sediment control methods, and Best Management Practices (BMPs) for controlling the stormwater runoff produced and discharged from a construction site. Such “qualified” personnel include licensed professional engineers (P.E.s), a certified professional in erosion and sediment control (cpesc), a certified erosion, sediment, and storm water inspector (cesswi), or any person capable of assessing compliance of construction site practices that have the potential to impact stormwater quality resulting from project activities.
Illinois Final Stabilization for Construction Activites
In accordance with the Illinois Environmental Protection Agency, Federal and state regulations, and the requirements of this permit; a description of temporary and permanent stabilization methods, including site specific scheduling of them, is mandatory to the completion of all construction projects and required prior to the submittal of a Notice of Termination (NOT).
Final Stabilization requirements include the following:
(1) Existing vegetation is persevered where reasonably possible
(2) A record of the dates when temporary or permanent stabilization activities occur should be documented throughout construction activity.
(3) Stabilization methods should be initiated for any portion of the site where all construction related activities have temporarily or permanently ceased. Such methods may include: temporary seeding, permanent seeding, mulching, geotextiles, sod stabilization, vegetative buffer strips, protection of trees, preservation of mature vegetation, staged development, or any other appropriate Best Management Practices (BMPs).
(4) Stabilization methods are to be implemented as soon as reasonably possible, or no more than seven (7) days from the date of construction completion for any portion of the site where construction activity will not resume within fourteen (14) days from the date activity ceased.
Illinois Stormwater Permit Termination Process- Notice of Termination (NOT)
Any construction site within the state of Illinois that has achieved final stabilization and all stormwater discharges from construction activities are covered by this permit, may file a Notice of Termination (NOT) report to the Illinois Environmental Protection Agency (IEPA).
The following criteria is necessary to the filing of a compliant Notice of Termination (NOT):
(1) Mailing address if applicable, or the longitudinal and latitudinal coordinates of the construction site.
(2) Owner or operator’s name, address, and contact information.
(3) Permit compliant signatures.
(4) All land disturbing activities related to project site completion have ceased.
(5) Final stabilization and the elimination of stormwater discharges associated construction activities has been properly achieved prior to submittal of the Notice of Termination (NOT).
