Alabama State Overview
Stormwater runoff (discharge) from Alabama construction sites is regulated under section 402 of the Clean Water Act (CWA). Section 402 outlines the National Pollutant Discharge Elimination System (NPDES) permitting program. The Alabama Department of Environmental Management’s NPDES permitting program requires owners or operators of construction sites that disturb 1-acre or greater and sites less than 1-acre but are part of a larger common plan of development or sale to obtain authorization to release stormwater runoff from construction sites.
The rules and regulations associated with Alabama’s NPDES General Permit for Construction Activities are intended to protect the natural water resources of the State of Alabama. These regulations are vital to Alabama’s effort to protect and improve water quality within the state. These important regulations were framed in accordance with and subject to the provisions of the Federal Water Pollution Control Act, Alabama Water Pollution Control Act and the Alabama Environmental Management Act.

Alabama Stormwater Permit Applicaton Process
Any person wishing to obtain coverage under the Alabama NPDES General Permit needs to submit a Notice of Intent (NOI) prior to the start of construction and only after a complete and correct NPDES annual Notice of Registration has been submitted to Alabama Department of Environmental Management.
The NOI must be accompanied by a Construction Best Management Practices Plan (CBMPP) completed by a Qualified Credentialed Professional (QCP), Professional Engineer (PE) or a certified professional in erosion and sediment control.
Alabama Storm Water Pollution Prevention Plan Requirements
The Alabama Department of Environmental Management (ADEM) requires owners or operators of construction sites that disturb 1-acre or greater and sites less than 1-acre but are part of a larger common plan of development or sale to submit a Construction Best Management Practices Plan (CBPM).
The plan must describe how the permittee will effectively design, install and maintain effective erosion controls, sediment controls and pollution prevention measures appropriate for the site conditions. Plans should be designed and maintained to minimize erosion and maximize sediment removal resulting in a 2-year 24-hour storm event.
The CBMPP shall be completed by a Qualified Credentialed Professional (QCP), Professional Engineer or a certified professional in erosion and sediment control.
Alabama Construction Storm Water Inspection Frequency
The Alabama Department of Environmental Management (ADEM) requires owner/operators of construction sites that disturb 1-acre or greater and sites less than 1-acre, but part of a common plan of development or sale, to maintain construction sites in accordance to the Construction Best Management Practices Plan (CBMPP) submitted with the Notice of Intent.
The permittee shall visually monitor the active portion of the site and document Best Management Practice (BMP) deficiencies and log any rainfall.
Complete and comprehensive site inspections must be performed once each month and after qualifying precipitation events. Precipitation inspections shall commence as soon as possible, but no later than 72 hours after each qualifying event.
Alabama Construction Stormwater - Credential Requirements
The Alabama Department of Environmental Management (ADEM) requires that at least one onsite employee be certified as a Qualified Credentialed Inspector (QCI), Qualified Credentialed Person (QCP) or a Qualified Person. To become a QCI you must complete an Alabama Department of Environmental Management approved training program and attend annual refresher training.
The Construction Best Management Practices Plan (CBMPP) must be prepared by a Qualified Credentialed Professional (QCP), Professional Engineer or a certified professional in erosion and sediment control.
StormwaterONE.com is currently NOT AN APPROVED QCI/QCP educational provider with the Alabama Department of Environmental Management, however, Professional Engineers may consider completing the Qualified Preparer of Storm Water Pollution Prevention Plans (QPswppp) program. The QPswppp online certificate program covers all aspects of Erosion Control, Sediment Control, Pollution Prevention, Onsite Construction Inspections and the Preparation of a Compliant Storm Water Pollution Prevention Plan.
Alabama Final Stabilization for Construction Activities
The Alabama Department of Environmental Management (ADEM) requires the permittee to initiate vegetation whenever any clearing, grading, excavating or other earth disturbing activities have permanently ceased on any portion of the site. Similarly, temporary stabilization must be initiated immediately whenever work toward project completion and final stabilization of any portion of the site has temporarily ceased on any portion of the site and will not resume for a period exceeding thirteen (13) calendar days.
Alabama Stormwater Permit Termination Process - Notice of Termination (NOT)
Once final stabilization has been achieved and all clearing, grading, excavating or other earth disturbing activities have permanently ceased on the site; all construction materials, waste, and temporary erosion and sediment control measures (including any sediment that was being retained by the temporary erosion and sediment control measures) have been removed and properly disposed; the operator has 30 days to terminate permit coverage.
To terminate permit coverage the operator must submit a complete and accurate Notice of Termination (NOT) form. Operators may submit a paper copy (photocopy/ fax/ e-mail/ electronic) to the ADEQ or use the electronic submission process via the Smart NOI Web site at: https://az.gov/app/smartnoi/ .
