Welcome to StormwaterONE! The terms “we,” “us,” and “our” refer to StormwaterONE. StormwaterONE operates this website and store, including all related information, content, features, tools, products, and services (the “Services”). Our Services include access to online and in-person occupational training courses, digital materials, certifications, and related products. StormwaterONE is powered by Shopify, which enables us to provide these Services to you.

These Terms of Service, together with our Privacy Policy and any other policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you use the Services.

By visiting, enrolling in a course, purchasing, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, or you have given consent for a minor dependent to use the Services under your supervision.

To enroll in a course or make a purchase, you may need to provide accurate and complete information, including your name, email, billing, and payment details. You are solely responsible for maintaining the confidentiality of your account and login credentials, as well as for all activity under your account. Course enrollments are personal and may not be shared, sold, or transferred.

SECTION 2 - OUR COURSES AND PRODUCTS

StormwaterONE provides online and in-person training courses, certificates of completion, and related educational products.

  • Educational Use: Enrollment grants you a limited, non-transferable license to access course materials for personal educational purposes only. You may not share, copy, reproduce, distribute, or resell course content.
  • Certificates: Certificates of completion may be issued upon successfully meeting course requirements. We do not guarantee employment, licensure, or regulatory approval. It is your responsibility to confirm acceptance of training with any applicable agency, employer, or governing body before enrollment.
  • Accuracy: We strive to provide accurate course and product descriptions, but we do not warrant that any content will meet your expectations. Course content may be updated, modified, or discontinued at any time.

SECTION 3 - ORDERS AND ENROLLMENT

Placing an order constitutes an offer to purchase. Orders are not accepted until we confirm payment and enrollment. We may reject or cancel any order in our sole discretion.

Refunds, cancellations, and rescheduling are governed by our Refund Policy.  Unless otherwise specified:

  • Refunds are generally available only if requested within 30 days of purchase and before completing the final exam.
  • No refunds will be provided once course materials have been completed or an in-person class has been attended.
  • Rescheduling for in-person training may be available subject to availability and our discretion.

SECTION 4 - PRICES AND BILLING

All prices, promotions, and discounts are subject to change. The price charged is the one in effect at the time of purchase, as set out in your order confirmation. Prices are exclusive of taxes, shipping, handling, or other applicable fees unless stated otherwise.

You agree to provide current and accurate payment information and authorize us to charge your chosen payment method. You represent that you are authorized to use the payment method provided and agree to pay all applicable charges.

SECTION 5 - SHIPPING AND DELIVERY

For physical products, shipping and delivery times are estimates only. Title and risk of loss transfer to you once products are handed to the carrier. We are not responsible for delays caused by carriers, customs, or events outside our control.

SECTION 6 - INTELLECTUAL PROPERTY

All course materials, content, and other elements of the Services—including text, graphics, videos, slides, handouts, logos, and certificates—are owned by StormwaterONE or our licensors and are protected under intellectual property laws.

You may use the Services only for your personal educational purposes. You may not reproduce, distribute, share, modify, or create derivative works from our materials without prior written permission. Certificates of completion may only be issued by StormwaterONE and must not be altered or reproduced.

All rights not expressly granted are reserved by StormwaterONE.

SECTION 7 - OPTIONAL TOOLS

We may provide access to third-party tools or integrations. Such tools are provided “as is” and without warranties. Your use of these tools is at your own risk and may be subject to the provider’s terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third parties and disclaim liability for your use of their products, services, or content. Please review their terms before engaging in any transactions.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

StormwaterONE is powered by Shopify. However, all sales and enrollments are made directly with StormwaterONE. Shopify is not responsible for your purchases, training, or any resulting claims. By using our Services, you release Shopify from liability related to your transactions with StormwaterONE.

SECTION 10 - PRIVACY POLICY

We collect personal and student information to provide and improve our Services. This includes enrollment records, course progress, and certificates. All personal data is handled according to our Privacy Policy.  By using the Services, you consent to such data collection and processing.

SECTION 11 - FEEDBACK

If you submit feedback, suggestions, or reviews, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such content for any purpose.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

We may correct errors or inaccuracies at any time without notice, including after you have submitted an order.

SECTION 13 - PROHIBITED USES

You agree not to misuse the Services, including but not limited to: unlawful activity, harassment, IP infringement, spreading malware, or attempting to resell course access. Violation may result in suspension or termination of your account.

SECTION 14 - TERMINATION

We may suspend or terminate your access at any time for violation of these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and other provisions survive termination.

SECTION 15 - DISCLAIMER OF WARRANTIES

The Services and training are provided “as is” without warranties of any kind. We do not warrant that course completion ensures employment, licensure, or compliance with regulatory standards.

SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, StormwaterONE and its affiliates shall not be liable for indirect, incidental, special, or consequential damages, including lost income, data, or opportunities, arising from use of the Services.

SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold harmless StormwaterONE and our partners against claims, damages, or expenses arising from your breach of these Terms, violation of law, or misuse of the Services.

SECTION 18 - SEVERABILITY

If any provision is deemed unlawful or unenforceable, the remainder of these Terms remains valid.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and StormwaterONE and supersede prior agreements. Failure to enforce any provision does not waive our right to enforce it later.

SECTION 20 - ASSIGNMENT

You may not transfer your rights or obligations without our written consent. We may assign or transfer our rights without notice.

SECTION 21 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut where StormwaterONE is headquartered. You consent to jurisdiction in the applicable state and federal courts.

SECTION 22 - HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update or revise these Terms by posting changes on our website. Material changes will be communicated as required by law. Your continued use constitutes acceptance of any changes.
