As authorized by the Clean Water Act (CWA), the NPDES permit program controls water pollution by regulating point sources that discharge pollutants into waters of the United States. \u003cbr\u003e\u003cbr\u003eThe EPA Phase II Final Rule requires an operator of a regulated small MS4 to develop, implement, and enforce a program to reduce pollutants in stormwater runoff to their MS4 from construction activities that result in a land disturbance of \u003cstrong\u003eGREATER than or EQUAL to ONE (1) acre\u003c\/strong\u003e.\u003cbr\u003e\u003cbr\u003eThe MS4 operator is required to have an ordinance or other regulatory mechanism requiring the implementation of proper erosion and sediment controls, and controls for other wastes, on applicable construction sites.
